Tax Residency Certificate

Tax Residency Certificate (TRC)

Tax in any country is driven by the residential status of an individual or entity. At the same time, the chargeability of any income is determined by both source and residency rules, which vary from country to country. When both these rules apply to the same income, double taxation arises. This is where DTAA (Double Taxation Avoidance Agreement) and TRC (Tax Residency Certificate) come into play.

Whenever we talk about foreign taxation or double taxation, the first document your tax advisor would ask for is the TRC (Tax Residency Certificate), also known as the tax domicile certificate. Let’s learn more about this crucial aspect of foreign taxation.

What is a Tax Residency Certificate (TRC)?

A Tax Residency Certificate (TRC) is proof of residency in a country that enables an individual or entity to claim relief under the provisions of the applicable DTAA (Double Taxation Avoidance Agreement).

All Indian residents who have active income from countries with which India has a DTAA agreement can obtain a Tax Residency Certificate in India from the Income Tax Department to avail of treaty benefits.

To understand the importance of TRC, it is essential to first understand DTAA and the concept of double taxation.

What is Double Taxation Avoidance Agreement (DTAA)?

A Double Taxation Avoidance Agreement (DTAA) is a treaty between two or more countries designed to avoid taxing the same income twice. It defines tax rates and taxing rights for specific types of income arising in one country and earned by residents of another.

For example, if a taxpayer resides in one country but earns income in another, DTAA provisions allow relief if a treaty exists between the two countries.

Types of DTAA:

  • Comprehensive DTAA – Covers all categories of income
  • Specific DTAA – Covers particular income types such as salary, capital gains, services, property, etc.

Key Aspects Covered Under DTAA

  • Relief from taxation in both countries
  • Prevention of double taxation
  • Exchange of tax-related information between countries
  • Assistance in recovery of income tax dues

What is Double Taxation?

Double taxation occurs when the same income, asset, or transaction is taxed by more than one country. DTAA treaties help eliminate or reduce this burden, ensuring fair taxation for taxpayers.

Who Can Obtain a TRC?

  • Individuals
  • Corporates (Companies, Firms, LLPs, etc.)

How Can an Indian Resident Obtain a TRC?

An Indian resident assessee must apply for a Tax Residency Certificate by submitting Form No. 10FA to the Assessing Officer.

After verification, the Assessing Officer issues the TRC in Form No. 10FB.

Important: TRC cannot be applied for online; it must be obtained through the Income Tax Department.

How Can a Non-Resident Assessee Obtain a TRC?

A non-resident taxpayer must obtain a TRC from the tax authorities of the country where they claim tax residency.

The TRC must contain the following details:

  • Name of the applicant
  • Status (Individual, Company, Firm, etc.)
  • Nationality (for individuals)
  • Country of incorporation or registration (for entities)
  • Tax Identification Number (TIN)
  • Residential status for tax purposes
  • Applicable period of residency
  • Complete address for the applicable period

Additionally, non-resident taxpayers must furnish these details in Form 10F, duly verified by the foreign tax authorities.

Benefits of Having a Tax Residency Certificate

1. Relief from Double Taxation

An Indian resident earning income from a foreign country may otherwise be taxed in both jurisdictions. By submitting a TRC, the taxpayer can claim DTAA benefits and avoid double taxation.

2. Transparency in International Remittances

In cases of export of goods or services, foreign entities may require a TRC before releasing payments. This ensures transparency and treaty compliance in cross-border transactions.
